Volunteer Waiver and Release of Liability
Event: Muskoka Marathon

1. Acknowledgment of Risk
I understand that volunteering at the Muskoka Marathon (the “Event”) involves inherent risks, including but not limited to: interaction with large crowds; exposure to traffic, vehicles, and roadways; uneven terrain; slips, trips and falls; physical exertion including lifting and prolonged standing; weather conditions including heat, cold, and rain; and exposure to communicable illnesses. These risks may result in personal injury, illness, property damage, or death.
2. Assumption of Risk and Responsibility
I voluntarily agree to participate as a volunteer and assume full responsibility for all risks, known and unknown, associated with my participation. I confirm that I am physically able to perform my assigned duties and will inform event organizers of any limitations.
3. Compliance with Instructions
I agree to follow all safety instructions, training, and directions provided by event organizers. Failure to do so may increase risk and may result in removal from volunteer duties.
4. Release and Waiver of Liability
In consideration of being permitted to volunteer, I hereby release, waive, and discharge 1771632 Ontario Limited (Muskoka Marathon), Santa’s Village, the Town of Bracebridge, the District of Muskoka, sponsors, partners, and all affiliated parties from any and all liability, including liability arising from negligence, to the fullest extent permitted by law.
I understand that this agreement includes a release of liability for negligence and that I am giving up certain legal rights, including the right to sue.
5. Indemnification
I agree to indemnify and hold harmless the above parties from any claims arising from my participation, including claims caused by my own actions, omissions, or failure to follow instructions.
6. Medical Treatment
I consent to receive emergency medical treatment if necessary and accept responsibility for any associated costs.
7. Insurance
I understand that I am responsible for my own personal insurance coverage, including health and accident insurance.
8. Photography and Media Release
I grant permission for my image and likeness to be used for promotional purposes without compensation.
9. Code of Conduct
I agree to act safely and respectfully, not consume alcohol or drugs while volunteering, and report any hazards or incidents.
10. Voluntary Participation / No Employment Relationship
I am participating voluntarily and understand that this agreement does not create an employment relationship.
11. Governing Law
This agreement shall be governed by the laws of the Province of Ontario and Canada.
12. Severability
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
This agreement constitutes the entire agreement and supersedes any prior representations or agreements.
14. Acknowledgment and Signature
I have read this agreement, understand its terms, and sign it voluntarily. I have had the opportunity to ask questions.
